PAYMENT & DELIVERY

1. Subject matter and conclusion of the contract

(1) The seller offers its customers high-quality jewelry for sale in its online shop. The seller's offers are aimed exclusively at customers in the European Union.

 

(2) Price labels in the online shop do not constitute an offer in the legal sense. Before bindingly placing his order by clicking the button “order with payment obligation”, the customer can correct all entries at any time using the usual keyboard and mouse functions. In addition, all entries are displayed again in a confirmation window before the order is bindingly placed and can also be corrected there using the usual keyboard and mouse or, if applicable, touchscreen functions.

 

(3) The purchase agreement in the online shop is concluded as follows:

  • a) If you have selected the “PayPal” or “PayPal Express” payment method, the purchase agreement is concluded at the time of confirmation of the payment instruction to PayPal.

  • b) If you have selected the “credit card” payment method, the agreement is concluded at the time of the credit card charge.

  • c) In all other cases, the purchase agreement shall be concluded upon the seller's acceptance of the customer's order. The seller is entitled to accept the offer contained in the order within 2 working days by sending an order confirmation. The customer shall receive an e-mail confirming receipt of the order and conclusion of the agreement.

(4) The customer shall receive the text of the agreement and these General Terms and Conditions, as well as the cancellation policy, with the notification of the conclusion of the agreement.

 

(5) A customer also has the option of enquiring about a specific item by telephone or by email, fax or letter to the seller. After receiving such an enquiry, the seller shall make the customer a separate offer by

email, letter or fax. A contract shall only be formed when the customer accepts this offer.

 

2. Prices, sales tax and payment

(1) The prices stated in the online shop apply. All prices stated in the online shop are final prices and include the respective statutory sales tax.

 

(2) The seller delivers to the customer against advance payment (payment by PayPal or “PayPal Express”, by credit card), unless otherwise agreed in individual cases.

 

(3) Payment is due no later than one week after conclusion of the contract.

 

(4) When the payment method “PayPal” or “PayPal Express” is selected, payment is processed by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22- 24 Boulevard Royal, L-2449 Luxembourg, under the PayPal terms of use, which can be viewed at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.

 

(5) If a customer defaults on his payment obligations, the seller may claim damages in accordance with the statutory provisions.

 

(6) The seller always issues an invoice to the customer, which is handed over to him upon delivery of the goods or otherwise sent to him in text form.

 

3. Delivery and Transfer of Risk

(1) The ordered goods shall be delivered to the address provided by the customer, unless otherwise contractually agreed. Delivery shall be made exclusively to addresses in the countries specified in Section 2 (1) of these Terms and Conditions. Delivery shall be made from the seller's warehouse. Shipping is free of charge.

 

(2) The availability of the individual goods is indicated in the item descriptions. For goods in stock, the delivery time is 7 calendar days from the conclusion of the contract, unless otherwise stated in the item description. For goods not in stock, the delivery time is 4-6 weeks from the conclusion of the contract, unless otherwise stated in the item description.

 

(3) The seller reserves the right to withdraw from the obligation to fulfill the contract if the goods are to be delivered by a supplier on the day of delivery and the delivery is not made in whole or in part. This reservation of self-delivery only applies if the seller is not responsible for the failure of the delivery. The seller is not responsible for the failure to perform if a so-called congruent hedging transaction to fulfill the contractual obligations was concluded in good time with the supplier. If the goods are not delivered, the seller will immediately inform the customer of this fact and refund any purchase price and shipping costs that have already been paid.

 

(4) The seller reserves the right to make a partial delivery if this appears advantageous for a speedy settlement and the partial delivery is not exceptionally unreasonable for the customer. The customer will not be charged for any additional costs incurred by partial deliveries.

 

(5) The risk of accidental loss and accidental deterioration of the goods shall pass to the customer at the latest upon delivery. If the customer is an entrepreneur, the risk of accidental loss and accidental deterioration of the goods, as well as the risk of delay, shall pass to the customer upon delivery of the goods to the forwarding agent, carrier or other person designated to carry out the shipment.
